Terms and Conditions

1.      Payment

  • Payment for the goods and delivery charges can be made by any method shown on the website or on your official quotation at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle the Supplier to terminate the contract immediately.
  • There will be no delivery until cleared funds are received.
  • Payments shall be made by you without any deduction whatsoever unless you have a valid court order requiring an amount equal to such deduction to be paid by the Supplier to you, or written authorisation for such a deduction exists between you and the Supplier, ie in the case of existing credit from previous legitimately returned goods, in which case such authorisation will be indicated on your quotation / pro-forma invoice.
  • In the case of EFT, please email your Proof of Payment to us with your order number as reference.

 

2.     Risk / Title

  • The goods are at your risk from the time of delivery.
  • Ownership of the goods shall not pass to you until the Supplier has received in full (cleared funds) all sums due to it in respect of:
    • the goods, and
    • all other sums which are, or which become due to the Supplier from you on any account.
    • The Supplier shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from the Supplier.

 

3.     Warranties

  • Most goods supplied by the Supplier are covered under manufacturer warranties. These differ between brands and models (higher end equipment typically have longer warranty periods. We advise you to read the manufacturer’s warranty information and familiarise yourself with the limitations thereof before using the equipment. This warranty does not affect your statutory rights as a consumer. Please feel free to contact us regarding any questions you might have related to warranties
  • The honouring of warranties on renewable energy equipment are heavily reliant on correct installation, and inclusion of all required protective devices. Please consult the user manual for your products and/or ensure your installer consults them in detail. The supplier will not be held liable for any omissions by the client related to specified instructions. Although we can advise, we cannot enforce the client’s decisions, nor control the installation conditions, and therefore we cannot be held liable for omissions. You may also contact us to request the literature.
  • In order to ensure fast and effective warranty claims, we highly recommend that you take clear pictures of the key protective devices and installation conditions and parameters before initial start-up. These pictures should be submitted to the Supplier who can file these images to assist with future warranty claims. The Client retains the responsibility to also store these images.
  • The following protective devices and installation conditions must be met as a minimum, although manuals might specify additional requirements. Please take pictures of all the following items as well. As evidence and verification of correct installation, we highly recommend you record and submit pictures to us before energizing the system:

 

4.     Limitation of Liability

  • If you are a consumer, the Supplier shall not be liable to you for any loss or damage in circumstances, where:
    • There is no breach of a legal duty owed to you by the Supplier or by its employees or agents.
    • Such loss or damage is not a reasonably foreseeable result of any such breach.
    • Any increase in loss or damage resulting from breach by you of any term of this contract.
  • If you are a business customer the Supplier shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses, or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.
  • We, the Supplier, shall not be held liable for any damages to new and/or existing installations due to the installation of our products. It is important for the customer to ultimately verify the compatibility of our products with their intended or existing systems, we recommend discussing with the installation electrician who will perform the installation.
    • If equipment is damaged due to incorrect installation and or operation, the warranty shall not be valid. It is therefore very important to ensure correct installation, setup, and operation.
    • Once damaged equipment has been returned to us, we shall send it to the National importer/ agent. The national agent for the equipment in question, shall perform an analysis regarding the reason for failure. The national agent’s assessment of the failure cause shall be final.

1.     Shipping and Insurance

 

  • The goods you order will be delivered to the address you give via a designated transport service. Door-to-door Couriers do not deliver to PO Boxes or the Post Office. At checkout, please provide a Street Address (where you can receive deliveries during working hours), along with contact details for a person who is authorised to take delivery of the items at the delivery address.
  • Renewable energy equipment varies significantly in size, weight and complexity. For this reason, flat-rate shipping cannot be applied, shipping costs are calculated specifically for each unique order.  
  • Your order’s weight is calculated using the higher value of actual or volumetric mass for each product. The delivery rate is calculated according to the sum of the volumetric weights of the items in your cart, the total price of the cart as well as the destination address. Products might have to be shipped from various of our satellite warehouses, and depending on the complexity of your order, products may be delivered separately, in different timeslots and by different transport companies. Although we endeavour to minimise the inconvenience of multiple deliveries, this is often necessary to reduce transport costs, which then results in a saving to you. To receive an estimate on the delivery charge, please enter your delivery details in the Estimate Delivery box on the Shopping Basket page. Please note that in isolated instances, the automated shipping estimates from 3rd party transport companies may be incorrect. In this case we will contact you to discuss the cost impacts.
  • If delivery cannot be made to your address for reasons beyond our control the Supplier will inform you as soon as possible.
  • Delivery timeframes for each courier are displayed on the checkout page before you complete the order. The complexity of your order, along with the size and mass of your products, might impact the delivery timeframes. These timeframes are valid for business days and take effect from the time that we dispatch your order. All packages are fully trackable and tracking numbers will be provided once your order has been shipped.
  • If you choose liability cover for your products (highly recommended), please note that liability cover is based on our replacement cost, and therefore if your products are lost, damaged or stolen, the liability cover pay-out will be made to the Supplier, not to the Client. We will then either send you a replacement order or we will refund the full order to you. It’s at our sole discretion to choose whether to replace or refund the order, as replacement stock may no longer be available.
  • If you choose to waive the liability cover offered with shipping, , and the following conditions shall take effect:
    • The liability cover rate will be deducted from the shipping charge
    • Risk of the purchased items shall transfer to the client immediately upon collection of items from the Supplier (including remote warehousing), by the shipping company. Any damages to, or losses of purchased items, shall be at the risk of the client.
  • If any parcel delivered by our couriers appears to be damaged, please be sure to verify both the contents and condition of the consignment in the presence of the courier driver. Phone us immediately if any product is damaged or missing. Liability for any shipments sent from us ends with the obtainment of a clean signature from the consignee upon delivery of the goods.
  • Items which will not be used immediately, should still be inspected and/or tested as soon as possible if it is safe to do so.

 

2.     Your Right of Cancellation

 

  • You have the right to cancel the contract at any time up to the end of 7 days after you receive the goods (see below). This right may only be exercised if the packaging is not opened and the good are returned unused.
  • To exercise your right of cancellation, you must give written notice to the Supplier by email / contact us section of our website, giving details of the goods ordered and (where appropriate) their delivery. Notification by phone is not sufficient.
  • If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to the Supplier at your own cost. The goods must be returned after prior arrangement to one of our satellite warehouses (This will be communicated with you). You must take reasonable care to ensure the goods are not damaged in the meantime or in transit and insured in full. Items and packaging will be inspected by the Supplier to ensure perfect condition of items.
  • Once you have notified the Supplier that you are cancelling the contract, the Supplier will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.  In all cases, as per Distance Selling regulation, we will deduct the delivery / carriage costs from the refund amount. You must return the goods to us at your own expense using an insured courier service. If you prefer to return the goods via our own courier instead of sending the items yourself, costs will be calculated as per 3. Such refund will be made after deducting reasonable costs for services rendered such as postage costs, credit card processing charges, system design and assembly costs etc.
  • An order cancelled in transit will incur the standard cancellation fee plus additional transit costs at the expense of the customer.

 

3.                  Returns:
a) Unopened and Sealed Products

You may return, at your own expense, any unopened and sealed product/s purchased from the supplier and receive a full refund of the purchase price within 14 days of the date of purchase. You will only be eligible for a refund if the product is returned to the supplier together with the original invoice.


b)  Opened and Unsealed Products

You may return opened and unsealed products purchased from the supplier and receive a refund of the purchase price minus 10% (Handling Fee) within 14 days of the date of purchase.  You will only be eligible for a refund if the product is returned to the supplier together with all its accessories, the original product packaging, and the original invoice.
 

c) Faulty Products

All faulty products will be covered in the relevant product warranty.

 

d) Non-Delivery

In the event of an order returned due to non-delivery (recipient not available at specified delivery address during attempts by our shipping partners), the transit costs will be at the expense of the customer.
